Terms of Service

These Terms are an electronic record under the Information Technology Act, 2000 and do not need a physical or digital signature.

1. Eligibility and accounts

• You must be at least 18 years old and able to enter a binding contract under the Indian Contract Act, 1872.
• If you use the Service for a business, you confirm you may bind that business, and “you” includes it.
• Give accurate details, keep your password secure, and tell us at once at support@selfieads.com if you suspect someone else is using your account. You are responsible for activity under your account.
• An account is for one person; do not share it.
• One free ad is offered per person. We may withdraw it from accounts made to get it more than once.

2. The Service

SelfieAds lets you upload selfies, photos, product images and other material, and use AI tools to make advertising scripts, pictures, video clips and finished ads (“Outputs”). Features, credit costs and limits are described on the Pricing page and may change. We give reasonable notice of a change that materially reduces a paid plan you have already bought.

3. Plans, credits and payment

• Prices are shown in Indian rupees or US dollars. Prices in rupees include GST.
• Subscriptions renew automatically at the end of each billing period, monthly or annual, until you cancel. If you pay with an Indian card, renewals follow the RBI e-mandate rules: your card issuer sends a notice at least 24 hours before each renewal, and a renewal above the limit RBI sets may need you to authenticate it.
• Plan credits are added every month, on monthly and annual billing alike, and unused plan credits do not carry over to the next month. Credit pack credits can be used for 12 months from purchase. Credits have no cash value and cannot be transferred.
• When a picture or clip starts, we hold the credits it needs. If it fails, the credits are returned; you are not charged for a generation that fails.
• Payments are processed by Stripe. We do not store your card, UPI or bank details.
• Failed payments. If a renewal payment fails, we may pause paid features until it succeeds.
• Price changes apply from your next billing period. We tell you at least 30 days in advance, by email or in the app.
• Refunds are covered by the Refund and Cancellation Policy.

4. Storage

Each plan includes storage for your ads and uploads: 250 MB free, 2 GB with a credit pack, 10 GB on Starter, 25 GB on Growth and 50 GB on Pro. When you reach the limit, new uploads and new ads wait until you delete something or upgrade. Ads you don’t open are deleted after the periods in section 8 of the Privacy Policy, after a week’s notice in your ads list.

5. Your content

• You own your content. You keep all rights in the selfies, photos, logos, text and other material you upload (“Your Content”).
• Licence to us. You give us a non-exclusive, worldwide, royalty-free licence to host, store, process, copy and modify Your Content only as needed to provide, secure and support the Service for you, including sending it to the providers listed in the Privacy Policy. The licence ends when you delete Your Content or your account, except for copies the law requires us to keep.
• No AI training. We do not use Your Content or your Outputs to train AI models.
• Your promises. You confirm that you own Your Content or have permission to use it, and that every identifiable person in it, including their face and voice, is 18 or older and has agreed to the use you are making of their likeness.

6. Outputs

• As between you and us, you own the Outputs you make, and you may use them for personal and commercial purposes, including running them as ads, subject to these Terms. We do not use your ads in our own marketing without your written permission.
• Outputs are made by AI. They may be inaccurate, may resemble content made for other users, and may not be protected by copyright. Review every Output before you use or publish it.
• You are responsible for making sure your ads comply with the law, the Advertising Standards Council of India (ASCI) Code and its guidelines on synthetically generated content in advertising (for example, labelling an ad “Video created using AI” where they require it), consumer protection rules on misleading advertisements, and the policies of the platforms where you run them.

7. Acceptable use

You must not use the Service to make, upload or share content that:

• uses the face, body or voice of a real person without their consent, or impersonates any person, brand or government body
• shows or targets anyone under 18
• is sexual, nude or intimate imagery of a real person, including “undressing” or face-swapped sexual images
• is a deepfake meant to deceive, including fake endorsements, a real customer’s testimonial that never happened, fake news or election-related content
• is defamatory, obscene, hateful or harassing, or promotes violence or self-harm
• infringes any copyright, trademark, personality right or other right
• makes false or misleading claims about products, health, finances or results, or advertises anything illegal
• breaks any law in India, including the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023 and the Consumer Protection Act, 2019

You also must not reverse engineer or scrape the Service, resell access, get around usage limits or safety filters, upload malware, or overload our systems.

Unlawful use of AI tools can lead to civil and criminal liability, and the law may require us to report it, remove content or share information with the authorities. We may remove content, and suspend or close accounts, that break this section, without refund.

8. Takedown and complaints

If you believe content made with SelfieAds uses your likeness without consent, infringes your rights or is otherwise unlawful, contact our Grievance Officer (section 17). We acknowledge a complaint within 24 hours and resolve it within 15 days, as Rule 3(2) of the IT Rules, 2021 requires, and act on complaints about intimate imagery or impersonation within the shorter times those Rules set.

9. Third-party services

The Service relies on third-party services, including AI model providers and Stripe for payments. Platforms where you publish your ads have their own terms. We are not responsible for their availability or actions, including an ad platform rejecting an ad or restricting an account.

10. Our intellectual property

The Service, its software, designs, stock avatars and templates, and the SelfieAds name and logo belong to us or our licensors. We give you a limited, revocable, non-transferable right to use the Service under these Terms, and to use our stock avatars and templates in ads made with SelfieAds, but not on their own or in other products. We may use feedback you give us without any obligation to you.

11. Availability

We aim to keep the Service available, but it is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, or that Outputs will meet your needs or achieve any advertising result.

12. Limitation of liability

To the extent the law allows:

• we are not liable for indirect, incidental, special or consequential loss, or for lost profits, revenue, data or goodwill
• our total liability for any claim relating to the Service is limited to what you paid us in the 12 months before the claim
• nothing in these Terms limits liability that Indian law does not allow us to limit, or your statutory rights as a consumer

13. Indemnity

You will indemnify us against claims, losses and costs, including reasonable legal fees, arising from Your Content, your Outputs as you use or publish them, or your breach of these Terms or the law.

14. Cancellation and termination

• You can cancel your subscription at any time from the Credits page, through Manage subscription. Access continues until the end of the period you have paid for.
• You can close your account at any time by writing to support@selfieads.com. We delete your data as the Privacy Policy describes.
• We may suspend or close your account if you break these Terms, do not pay, or the law requires it. Where reasonable, we give you notice and a chance to put it right.
• The sections on your content, Outputs, acceptable use, liability, indemnity and disputes continue to apply after your account closes.

15. Governing law and disputes

• These Terms are governed by the laws of India.
• We will first try to resolve any dispute informally: write to support@selfieads.com and allow us 30 days.
• If it is not resolved, it goes to arbitration by a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996. The seat and venue are Chennai, and the language is English.
• Subject to that, the courts in Chennai, Tamil Nadu have exclusive jurisdiction. This does not take away any right you have as a consumer to approach a Consumer Commission under the Consumer Protection Act, 2019.

16. General

We may update these Terms. We tell you about a material change at least 30 days before it applies, and using the Service after that date means you accept it. If any part of these Terms cannot be enforced, the rest still applies. Not enforcing a right does not waive it. You may not assign these Terms; we may assign them in a merger or sale of our business. These Terms, the Privacy Policy and the Refund and Cancellation Policy are the entire agreement on this subject.
